1. SCOPE OF THIS DATA PROTECTION NOTICE

1.1 This data protection notice applies to the collection, processing and transmission of personal data of users by

Playbrush GmbH, Obere Donaustrasse 71/9-12, 1020 Vienna, Austria, [email protected] ("Playbrush Austria"),

and

Playbrush Limited,1st Floor Millbank Tower, 21-24 Millbank, London, SW1P 4QP, United Kingdom ("Playbrush UK").

Individual processing operations in accordance with this data protection notice may take place under the joint responsibility of Playbrush Austria and Playbrush UK. In these situations, Playbrush Austria will act as your main contact for all data protection enquiries. For further information, please refer to the section "Information on Joint Controllership".

Playbrush Austria and Playbrush UK will subsequently be jointly referred to as "Playbrush".

1.2 This Privacy Notice relates to the processing of Personal Data by Playbrush in the course of

  1. the purchase of Playbrush Products through a Playbrush website under the domain playbrush.com and its subdomains (hereinafter collectively the "Playbrush Website");
  2. the registration of a user for one of the Playbrush subscription services;
  3. the use of one of the Playbrush mobile applications (APPs);
  4. the provision of services (e.g. insurance services) and
  5. the use of the Playbrush website. 

1.3 Data Subjects

The following persons are affected by the processing of personal data in the context of the provision of services by Playbrush:

  1. Visitors to the website ("Visitors")
  2. Customers who have purchased a Playbrush Product via the Webstore ("Customers")
  3. Customers who have purchased a Playbrush product via another seller of Playbrush products ("Retail Customers")
  4. Users of the Playbrush Apps ("Users")

1.4 General Information on Data Processing

Playbrush does not collect Personal Data as part of the purchase process when a Retail Customer (i) purchases a physical Playbrush Product in a retail shop (i.e., not through the Playbrush Web Store), whether in another online or brick-and-mortar shop.

However, in order to use a Playbrush product in combination with a Playbrush Mobile Application, registration is required. In this context, personal data is collected which is described in more detail in section 2.

The Playbrush Mobile Applications ("APPs") include all games made available by Playbrush in the mobile app store, in particular the Games

  • GUM PLAYBRUSH APP,
  • GUM SMART ONE APP 

(these, together with future published Playbrush mobile applications, collectively the "Playbrush Mobile Applications"), and all Playbrush web applications.

1.5 Playbrush has taken appropriate technical and organisational measures to ensure that all data processing is carried out in accordance with applicable data protection laws and that all user data is protected against theft, loss or manipulation. Please note that the Users themselves are responsible for the appropriate security and protection of their login data (username and password).

1.6 Any person using our services declares that they are at least 16 years of age. Playbrush reserves the right to verify the age of the Users at the time of registration or at any time thereafter. If one or more Users of a Playbrush Mobile Application are children under the age of 16, the registering user hereby declares that he/she is the holder of parental responsibility for such children and consents to the use of all Personal Data as set out in this Data Protection Notice for such children.

2. PERSONAL DATA PROCESSED BY PLAYBRUSH

Personal Data is data that can identify an individual, directly or indirectly, either independently or in combination with other data. Depending on a User's actions, Playbrush collects the following Personal Data, either automatically or as submitted by Users.

Use of the Playbrush website

Whenever Visitor uses the Playbrush website - this includes a mere visit to the website without a purchase or other interaction - data is collected by Playbrush Austria through the cookies and plugins.

Further details on the individual cookies used, their data collection and your choices can be found in the Cookies section at the end of this notice.

Purchase a product on the Playbrush website

During the purchase process of a Playbrush product on the Playbrush website, Playbrush Austria collects the following data:

  • First and last name
  • Invoice address
  • Delivery address
  • E-mail address
  • Telephone number

This Personal Data is stored by Playbrush in connection with the specification of the purchased product. In this context it is used solely for the purpose of fulfilling the contract, i.e. shipping the ordered Playbrush products to the Customers.

Payment Service Provider

In addition, after selecting the payment provider at the time of purchase, the User or Customer will be asked to provide his/her payment details to the selected service provider; however, these details will not be passed on to Playbrush. Rather, the individual is redirected to the relevant third party service provider who carries out the payment. This data and the authorisation to accept recurring payments are stored by the respective payment providers for the purpose of order processing but are not made accessible to Playbrush.

Stripe

Payments can be processed via the payment system of Stripe Payments Europe Ltd, 1 Grand Canal Street Lower, Grand Canal Dock, Dublin, Ireland.

We use a payment tool from the technology company and online payment service Stripe as part of the ordering process. If you select this for payment, the following data will be transferred to Stripe for processing the payment: name, bank data (account number, credit card number, passwords, TANs, etc.), IP address and contract data, e-mail address, your billing or shipping address, transaction history. This processing is carried out for the performance of the contract according to the payment method you have chosen. Braintree

Payments can be processed via the Braintree payment system of PayPal (Europe) S.à.r.l. & Cie. S.C.A., 22-24 Boulevard Royal, 2449 Luxembourg, Luxembourg.

PayPal processes the email address, delivery address, payment data and information about the purchased products (including transaction history) . This processing is done to fulfil the contract according to the payment method you have chosen. Information provided to Braintree is subject to PayPal's Data Protection Notice. PayPal

Payments can be processed via the payment system of PayPal (Europe) S.à.r.l. & Cie. S.C.A., 22-24 Boulevard Royal, 2449 Luxembourg, Luxembourg.

If you select "PayPal" as a payment option during the ordering process in our online shop, data will be transmitted to PayPal. The personal data transmitted to PayPal is usually your first name, last name, address, e-mail address, IP address, telephone number, mobile phone number or other data that is necessary for processing the payment. Personal data that is necessary for the processing of the purchase contract is also personal data that is related to the respective order. This processing is carried out for the fulfilment of the contract according to the payment method you have chosen.

Klarna

Payments can be made through the payment system of Klarna Bank AB (publ), registered in the Swedish Trade Register under company number 556737-0431 and with its registered office at Sveavägen 46, 111 34 Stockholm.

If you select "Klarna" as a payment option during the ordering process in our online shop, data will be transmitted to Klarna. The personal data transmitted to Klarna is usually your first name, last name, address, e-mail address, IP address, telephone number, mobile phone number or other data that is necessary for processing the payment. Personal data that is necessary for the processing of the purchase contract is also personal data that is related to the respective order. This processing is carried out for the fulfilment of the contract according to the payment method you have chosen.

Klarna collects further data in the further course of processing and payment processing, which includes the login data of your account. This processing is carried out independently of Playbrush. You can find more data protection information from Klarna at: https://www.klarna.com/de/datenschutz/

Using a Playbrush Mobile Application

As part of registering a User to use a mobile application, Playbrush UK and Playbrush Austria collects the following Personal Data:

  • Selected username (note that multiple usernames can be selected under a subscription, one for each player profile).
  • Age
  • Chosen password
  • Telephone number (optional)
  • Specified email address

The processing serves the purpose of providing the application and fulfilling any contractual agreements.

In addition, Playbrush UK collects the following Personal Data in connection with each registered User at the time of registration:

  • Country from which the request comes (from the region set on the device used to determine the language).
  • Hardware identification number of the Playbrush device used (via Bluetooth, used to make sure that the brushing data is only shared with the respective account to which the device is connected and it’s used for supporting customers in case of issues with their device and/or app)
  • Usage of the Playbrush Device (used to allow the best possible and customized user experience when using the apps)

Using the Playbrush device

Playbrush UK collects the following data when a physical Playbrush device is used, whether or not the User is registered. The data will only be transferred to the Playbrush App once the User connects the hardware device to the app. After the data is transferred to the Playbrush app, the user is able to see all his/her brushing statistics.

  • Duration of each toothbrushing session;
  • Timing and frequency of tooth brushing;
  • Tooth brushing method (direction and speed);
  • Pressure (only for electric toothbrush) ; and
  • Coverage of each toothbrushing session

(below and above together "rendering data")

If the Playbrush device is used in conjunction with a Playbrush mobile application, the cleaning data will be associated with the selected username. If the device was purchased directly from Playbrush, Playbrush can associate this with the order to improve customer service.

 

Information on Joint Controllership

In the context of providing the apps, Playbrush Austria works closely with its subsidiary Playbrush UK. This also concerns the processing of your Personal Data. The parties have jointly determined the order in which this data is processed in the individual processing stages. They are therefore jointly responsible for the protection of your personal data within the process stages described below (Art. 26 DS-GVO).

 

For which process stages is there joint responsibility?

  1. As part of the signup process in the app, your data will be collected by Playbrush Austria and Playbrush UK. The app is developed and technically administered by Playbrush UK, which is also the licensor of the APPs. In addition, you conclude service contracts (subscriptions) and any purchase contracts (hardware) with Playbrush Austria when you sign up.
  2. Playbrush UK and Playbrush Austria operate a central database in which all customer data, i.e. the data from the APPs, as well as the purchase information and any insurance benefits, are recorded and used for the fulfilment of the contract as well as for product improvement, support and for own marketing purposes (e.g. newsletter). In the majority of cases, this data is used by Playbrush Austria as the central point of contact. The processing by Playbrush UK is limited to the provision of the technical infrastructure, product and APP improvements and the granting of licensing rights to the users of the APPs.

What have the parties agreed?

As part of their Joint Controllership under data protection law, Playbrush Austria and Playbrush UK have set out their respective obligations under the GDPR. This concerns in particular the exercise of the rights of the data subjects and the fulfilment of the information obligations pursuant to Articles 13 and 14 of the GDPR.

This agreement is necessary because when using the Apps and Products, personal data is processed in different process stages and systems operated by both Playbrush Austria and Playbrush UK.

In section 4 you will find the description of the data collection, processing and transfers with reference to the respective service.

Even if there is Joint Controllership, the parties shall fulfil the data protection obligations in accordance with their respective responsibilities in accordance with the individual processing stages as described in section 4.

Playbrush Austria and UK shall make the information required under Articles 13 and 14 of the GDPR available to data subjects free of charge in a precise, transparent, comprehensible and easily accessible form in clear and simple language. In doing so, each party shall provide the other party with all necessary information from its sphere of influence.

The parties shall inform each other without delay on rights asserted by data subjects. They shall provide each other with all information necessary to respond to requests for information.

3. PROCESSORS

Playbrush cannot perform all data processing on its own. For the purposes of fulfilling contractual obligations with its users, providing support services, marketing and internal administration purposes, Playbrush uses the services of trusted third parties. These Processors of Playbrush have taken appropriate technical and organisational measures to ensure the protection of your data.

Below the processing carried out is described in detail:

o   Email confirmation: Playbrush Austria uses the email address provided to send an order confirmation and for any subsequent reconciliations/complaints handling of the order itself and the shipping process.

o   Website: The Playbrush Austria website is hosted by

  • Amazon Web Services EMEA SARL, Luxembourg. Server in EU

o   Data storage by Playbrush Austria and UK: All personal data collected by Playbrush is stored securely on servers of the following companies for the provision of contractual services and for administration and marketing purposes:

  • Amazon Web Services EMEA SARL, Luxembourg. Server in EU
  • ObjectLabs Corporation, 660 York St. Suite 101, CA 94110 San Francisco, USA (No transfer of the customer data to the USA is carried out as the data is stored on AWS in the EU)

o   Purchases: To enable purchasing on the Playbrush Austria website, personal data is stored with the operator of the Playbrush web shop:

  • Stripe Payments Europe Ltd, 1 Grand Canal Street Lower, Grand Canal Dock, Dublin, Ireland

o   Shipping: To ship the ordered products, Playbrush Austria transfers on the name, address and telephone number to the following logistics company:

  • SUXESS LOGISTIC GmbH, Wagramer Straße 120/37, 1220 Vienna, Austria.

o   Payment: Playbrush Austria does not receive any payment data when a purchase is made. Rather, the user is forwarded to a payment service provider who makes the payment. To enable payment, the user transmits his/her payment data to the payment service provider himself/herself within the framework of the forms integrated in the ordering process:

o   Recurring payments: If the user chooses a subscription for a regular supply of toothbrush products rather than a one-off purchase, the personal data may be forwarded to the following entities in order to store the data and make recurring payments and recurring shipments:

o   Support: If a user posts a question or comment in the Q&A/Help & Support section of the Playbrush website, the specific questions and user data (email address, name, username) will be processed by the following companies that help Playbrush provide user feedback:

o   Newsletter: We use the following service providers for sending and tracking the opening rates of the newsletters:

Transfer of data outside the EEA

For recipients of data located in countries where the EU Commission has not identified a sufficient level of data protection, such as recipients located in the USA, Playbrush has taken additional measures (appropriate safeguards) pursuant to Art. 46 GDPR. This includes, for example, the conclusion of agreements with the recipients of personal data on the basis of so-called EU standard data protection clauses issued by the European Commission pursuant to Art. 46 (2) GDPR.

4. DESCRIPTION OF DATA COLLECTION, PROCESSING AND TRANSMISSION

4.1. Processing of Personal Data by PLAYBRUSH Austria and PLAYBRUSH UK

Purpose:

  • Technical support for Users;
  • Prevention and detection of fraud;
  • Storage for the purpose of comparing toothbrushing performance data collected through the Playbrush mobile apps with other users' data by graphically displaying it under the respective alias name chosen;
  • Analysis of the collected cleaning data to develop personalised performance improvement advice for the respective user, which is provided to the user within the respective Playbrush mobile application or within the Playbrush Dashboard application;
  • Analysis of collected brushing data in relation to toothbrushing performance by aggregation with other users' data to explore toothbrushing behaviour and improvement opportunities in general;
  • Storage of brushing data for the purpose of in-app advertising: Based on toothbrushing performance (frequency, duration, accuracy), users receive reminders within the respective Playbrush mobile app to use their Playbrush or download more games;
  • Storage of brushing data on toothbrushing performance and aggregation of this data from multiple Playbrush mobile applications of a respective user in order to make it accessible to the respective user (or in the case of minors, to his/her legal guardian) on the Playbrush Dashboard web application and to display it graphically. Through this application, parents have the possibility to view the collected data of their children on the Playbrush.com platform, to assign them to user profiles and to compare them. In doing so, the data is displayed graphically and feedback on toothbrushing performance is provided. Playbrush profiles in the Playbrush Dashboard are always assigned to the profiles of the respective children (only using the chosen alias name). The data is only made available to the respective user (or in the case of minors, to their legal representative) and not to third parties. The cleaning data is always stored with a play profile in one of the respective Playbrush mobile applications in connection with the hardware identification number of the Playbrush device so that it can be clearly assigned.

Purpose:

As described in section 2, some personal data is collected by PLAYBRUSH Austria (in particular data provided through the Playbrush website) and some data is collected by PLAYBRUSH UK. The processing of this data for the purposes set out in this table will be shared between PLAYBRUSH Austria and PLAYBRUSH UK to the extent necessary to provide services to the user.

4.5. Registration for a Playbrush Mobile Application

In the course of registering for a Playbrush mobile application, you consent to the processing of the device data (use of the brush) for the purpose of providing the scope of use of the APP as well as the following processing:

4.5.1 Transfer of Data to The Rocket Science Group LLC (Mailchimp), 675 Ponce De Leon Ave NE Ste 5000, GA 30308 Atlanta, USA

Purpose:

For initial introductory emails to assist the user in activating the Playbrush; to send weekly updates on cleaning data analysis results and upsell offers. As part of the signup process, consent to:

(a) weekly with a summary of the duration and frequency of the cleaning dates and with offers of further rewards for the cleaning dates; and

(b) for non-subscription users, to receive emails with offers to sign up for a subscription.

Users have the right to revoke this consent at any time - this applies regardless of the use of other Playbrush services. To revoke, please send an email to [email protected].

Legal Basis for Processing:

Necessary system emails are sent in order to fulfill the contract. Marketing communication is sent on the basis of the consent of the data subject.

4.6 Registration for insurance

If a user explicitly requests dental insurance services from UNIQA, Austria, on the Playbrush website, the user consents to the collection, processing and transmission of the respective user's personal data as follows:

4.6.1 Transfer of Data to B Surance, Austria

Purpose:

(a) Insurance for children: B Surance works as an intermediary for the purpose of collecting and transferring this personal data to UNIQA, Austria, which the latter then uses to contact users regarding their insurance application and to provide them with an insurance quote.

(b) Insurance for adults: B Surance provides the same benefits as for the children's insurance. In addition, B Surance acts as an intermediary for the processing of insurance benefits. Customers upload the dental bill and bank details via the Playbrush app and B Surance handles the processing.

4.7. Legal Basis for Processing

Unless otherwise specific in this Data Protection Notice the main legal basis for the processing Personal Data is the performance of the contract entered into with the User, Customers and Retail Customers. Special Categories of Personal Data are processed under the required consent. Additionally, measures to ensure security of the systems and processes, product improvements and marketing are carried out based on the legitimate interests of Playbrush to reduce risk, improve products by analyzing customer issues and product use on an aggregated basis and to market the service to newsletter subscribers as well as existing and potential customers.

Additionally, processing may be carried out based on legal obligations such as bookkeeping, product warranty or taxation laws.

Details regarding the individual legal basis for processing Cookie-Data are provided at the bottom of this Data Protection Notice.

5. YOUR RIGHTS

You have the following rights in relation to the processing of your personal data. Each of the following rights can be exercised by sending a specific email describing your request from the email address registered with your username to [email protected] or [email protected].

5.1 You have the right to access personal data held by Playbrush. This means that you may have the right to obtain confirmation from us as to whether or not personal data relating to you is being processed and, if so, to request access to the personal data. The access information shall include, but not be limited to, the purposes of the processing, the categories of personal data concerned and the recipients or categories of recipients to whom the personal data have been or will be disclosed. However, this is not an absolute right and the interests of other individuals may limit your right of access.

5.2 You have the right to obtain a copy of the personal data to be processed.

5.3 You have the right to have inaccurate personal data corrected. This means that you may have the right to obtain from us the rectification of inaccurate personal data relating to you. Depending on the purpose of the processing, you have the right to complete incomplete personal data, for example by making a supplementary declaration.

5.4 You have the right to withdraw consent to the use of your data by Playbrush in whole or in part at any time or to request restriction of the processing of your personal data. Such revocation will not affect the lawfulness of the processing prior to the revocation of consent. Upon request, we will cease processing or transferring the data in accordance with this Privacy Notice. If such partial or total withdrawal makes it impossible or impractical for Playbrush to provide its services to you, Playbrush reserves the right to terminate the contractual relationship, provided that any payments you have already made will be refunded appropriately.

5.5 Right to object: You have the right to object to data processing by us at any time on grounds relating to your particular situation, provided that such processing is based on our legitimate interests. If you exercise your right to object, we will stop processing unless we can demonstrate compelling legitimate grounds for further processing that override your rights and interests.

Objection to direct marketing: if we process your personal data for the purpose of direct marketing, you have the right to object to the processing of your data for this purpose at any time. If you exercise your right to object, we will stop processing for this purpose.

5.6 You have the right to have your personal data deleted in certain cases. At the request of the user, all of the user's personal data will be permanently deleted, provided that no legal obligations prevent deletion.

5.7 You have the right to data portability, i.e. to receive the data relating to you in a structured, commonly used and machine-readable format and to have it transferred by Playbrush to another controller.

5.8 You also have the right to lodge a complaint with the competent data protection supervisory authority, in particular in the EU Member State of your habitual residence or of an alleged breach of data protection law.

 

6. HOW LONG DOES PLAYBRUSH STORE THE PERSONAL DATA COLLECTED?

All personal data collected by Playbrush will only be stored for as long as necessary for the performance of the contract with users or for the purposes described, unless longer storage is required by law (e.g. 7 years for tax and audit purposes for billing data).

 

7. AMENDMENT OF THE DATA PROTECTION NOTICE

Playbrush reserves the right to modify this Privacy Notice from time to time, in particular, but not limited to, to comply with legal requirements or requests, to be commercially reasonable, or to accommodate user interests.
